Elk Grove residents,
We have the opportunity to persuade our City Council to adopt a cell phone right to know ordinance just like the City of Berkeley adopted in 2015. The goal here would be to raise people’s awareness of the fact that yes, long term exposure to electromagnetic radiation (EMR) is hazardous. Scroll down for the online petition.
In late 2019 the U.S. Court of Appeals for the Ninth Circuit ruled in favor of the City of Berkeley and against the CTIA (the wireless companies’ bulldog and lobbying group) which had sued the City to block its cell phone right to know ordinance. More information about the Berkeley ordinance is on this page.
In December, 2019 the U.S. Supreme Court denied the CTIA’s appeal, which left the Ninth Circuit court’s ruling in place. That is the last appeal that CTIA can file over this. It means that the Berkeley right to know ordinance is here to stay. This gives hope to any other city that wants to adopt a similar ordinance; namely, that if their ordinance is the same as Berkeley’s the CTIA will not sue them.
On this page is a petition to the City Council asking them to do this. You can complete this petition and I (Mark) will forward the list of petition signers to the City. I will represent it accurately. I will not share your contact information with anybody.

To the Elk Grove City Council,
Please adopt a cell phone right to know ordinance just like the City of Berkeley’s. Most Elk Grove residents are not aware of the health and safety warnings in their cell phone owner’s manual about radio frequency (RF) electromagnetic fields (EMF) and they use their phones in potentially harmful ways. The ordinance should say:
A cell phone retailer shall provide to each customer who buys or leases a cell phone a notice containing the following:
The City of Elk Grove requires that you be provided the following notice:
To assure safety, the Federal Government requires that cell phones meet radio frequency (RF) exposure guidelines. If you carry or use your phone in a pants or shirt pocket or tucked into a bra when the phone is ON and connected to a wireless network, you may exceed the federal guidelines for exposure to RF radiation. Refer to the instructions in your phone or user manual for information about how to use your phone safely.
